My name is Adelmo Ribeiro and I’m a brazilian attorney. In this article, I would like to talk about the process of marriage in Brazil.

There are two list of documents that you (foreign) may need to get married in Brazil: 1) Documents of the person of brazilian orign. 2) Documents of the foreign person.
The obvious questioning is: Doctor, what are the documents?
In view to clarify this questioning, I’ve made 2 lists of documents.
For the person of brazilian orign:
- Certidão de Nacimento (Birth certificate).
- Declaração de Estado Civil (Civil Status Declaration or certificate)
- Comprovante de residência ( Residente certificate or declaration).
- RG, CPF (Identification documents).
For the person of foreign orign:
- Certidão de Nacimento (Birth certificate).
- Declaração de Estado Civil (Civil Status Declaration or certificate – To get this document, you have to go after your government or notary public. There, you’re going to issue a declaration in wich you expose that you have no impediment to get married)
- Comprovante de residência ( Residente certificate or declaration).
- Original Passport (Identification documents).
- Proxy, made in Notary Public and certified.
Its important to say that all the documents of the foreign people must be apostille in the brazilian consulate or another valid repartition (before sending). There’s another legal require that’s that the documents must be issued in the last 90 days.
Then, when this documents arrive in Brazil, you’ll have to translate everything with the oficial translator, here called “tradutor juramentado”. This is really important for legal validity.
Dr. Adelmo, I have all the documents, what should I do now?
With all the documents in Brazil, you’re going to start the process in the Civil Registry Office (Cartório de Pessoas Naturais Brasileiro). After checking all documents and paying the taxes, you’re really close do get married. Edicts are going to be disposed in the newspaper and, if everything is okay, you just have to sign the marriage paper and be happy.
